These Targeted Driver Promotions Terms & Conditions (“Promotion Terms”) govern participation in promotional campaigns offered by Miwayz Lanka (Private) Limited (“Miwayz”, “we”, “our”, or “us”) exclusively to selected drivers.
These Promotion Terms are supplementary to the Miwayz Terms & Conditions. By participating in any Targeted Driver Promotion, you acknowledge that you have read, understood and agree to be bound by these Promotion Terms together with the Miwayz Terms & Conditions.
1. Eligibility
1.1 Invitation Only
Participation in a Targeted Driver Promotion is by invitation only and is available exclusively to drivers selected by Miwayz.
1.2 Promotion Requirements
Each Targeted Driver Promotion will clearly communicate its applicable:
- Promotion Period;
- Eligibility requirements;
- Qualifying trip requirements;
- Reward amount;
- Payment timeframe; and
- Any additional conditions applicable to the promotion.
1.3 Driver Responsibility
Drivers are responsible for ensuring that they satisfy all published promotion requirements before participating.
1.4 No Entitlement
Selection for one Targeted Driver Promotion does not create any entitlement or expectation to participate in future promotions.
1.5 Account Standing
Drivers must maintain an active Miwayz Driver account in good standing throughout the applicable Promotion Period.
2. Qualifying Trips
2.1 General Requirement
Unless otherwise stated, only qualifying trips completed through the Miwayz Platform during the applicable Promotion Period shall be eligible.
2.2 Qualification
Miwayz shall determine whether a trip satisfies the requirements of the applicable promotion.
2.3 Non-Qualifying Trips
Trips that are cancelled, reversed, refunded, invalid, non-genuine or otherwise fail to satisfy the applicable promotion requirements shall not qualify.
3. Verification
3.1 Verification Requirement
All promotional rewards are subject to verification by Miwayz before payment.
3.2 Verification Process
Miwayz may use automated systems, manual reviews or any other reasonable verification process to determine eligibility.
3.3 Payment Timing
Where verification is required, promotional rewards may be withheld or delayed until the verification process has been completed.
3.4 No Automatic Entitlement
Participation in a promotion does not guarantee entitlement to a promotional reward until Miwayz has successfully completed its verification process.
4. Fair Participation
Targeted Driver Promotions are intended to reward genuine activity on the Miwayz Platform.
Miwayz reserves the right to investigate any activity that reasonably appears to be inconsistent with the purpose of a promotion or these Promotion Terms.
Where Miwayz reasonably determines that any account, trip or promotional activity is fraudulent, dishonest, abusive, manipulated, non-genuine or otherwise ineligible, Miwayz may, to the extent permitted by applicable law:
- disqualify the driver from the promotion;
- withhold, delay, cancel or recover any promotional reward;
- suspend or remove the driver’s eligibility from current or future promotions;
- suspend or restrict the driver’s account where appropriate under the Miwayz Terms & Conditions; and
- take any other action available under the Miwayz Terms & Conditions or applicable law.
5. Promotional Rewards
5.1 Reward Conditions
Promotional rewards are non-transferable and may only be awarded to the eligible driver who satisfied the applicable promotion requirements.
5.2 Errors
Miwayz reserves the right to correct any promotional reward awarded or paid as a result of a technical malfunction, administrative error, system error or incorrect qualification.
5.3 Recovery of Rewards
Where a promotional reward has been awarded incorrectly or obtained contrary to these Promotion Terms, Miwayz reserves the right to cancel, reverse, recover or offset such reward against future amounts payable to the driver, to the extent permitted by applicable law.
6. Promotion Changes
Miwayz reserves the right to amend, suspend, extend, replace or cancel any Targeted Driver Promotion where reasonably necessary, including for operational, commercial, technical, regulatory or fraud prevention purposes.
Where reasonably practicable, Miwayz will communicate material changes through the Miwayz Platform or other official communication channels.
7. No Guarantee of Future Promotions
Targeted Driver Promotions are discretionary promotional campaigns offered for limited periods.
Nothing contained in these Promotion Terms shall create any contractual right or legitimate expectation that:
- a driver will be selected for any future promotion;
- any promotion will continue for any particular duration;
- promotions will be repeated; or
- promotions of a similar nature or value will be offered in the future.
8. Relationship with the Miwayz Terms & Conditions
These Promotion Terms supplement the Miwayz Terms & Conditions.
Where these Promotion Terms are silent, the Miwayz Terms & Conditions shall apply.
In the event of any inconsistency, the specific terms of the applicable Targeted Driver Promotion shall prevail to the extent of that inconsistency, followed by these Promotion Terms and then the Miwayz Terms & Conditions.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Miwayz shall not be liable for any loss, damage, expense or claim arising from:
- a driver’s failure to qualify for a promotion;
- any delay in verification or payment of a promotional reward;
- the amendment, suspension or cancellation of a promotion; or
- disqualification resulting from non-compliance with these Promotion Terms.
Nothing in this clause excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
10. Administration
Miwayz shall administer all Targeted Driver Promotions in accordance with these Promotion Terms and the applicable promotion requirements.
Miwayz will determine eligibility, qualification, verification and promotional reward payments reasonably, in good faith and in accordance with the published promotion requirements.
